There is nothing I can do except send the seller a nasty note. Which I did. I tried multiple things first time around.
It now belongs to the insurance company because they gave me $4800 for it and I bought a JP 379B from Bloke and am happy. If anyone wants a JP horn, let Bloke give it a shot.

I am glad you found something, but I am so sorry that pursuing official avenues was fruitless.

Have you considered reporting this eBay sale to your insurance company, and letting them know that if they recover it that you would like to purchase it? They can probably coerse eBay into tracking down exactly who purchased it, where it is, and sending a representative along with the police to go fetch it.

I followed up with Ebay and my insurance company. The key problem was that the "seller" did not list the serial number or was willing to give the serial number. The local sheriff was looking to go and buy it and arrest the seller in the process IF they had the serial number and could definitively identify it as the stolen horn. They wanted to know it was the horn before they moved and my word that it looked like mine wasn't proof enough for an arrest. I understand their concern and reasons why they could not make a move.
If you look at the picture closely, there is a large dent in the bell. That was not there last time I saw it and it must have been put in by the thief. Anybody in my area who would do tuba repairs *or* might buy a student tuba has been notified so a shop might refuse to repair it.
